3. Reservations and Deposits

The Site currently offers reservations and refundable deposits for upcoming PHNTM products (such as the Paragon collection) rather than direct sales of finished goods. The following terms apply to all reservations and deposits made through the Site:

  • Nature of a reservation. A reservation is a deposit that reserves pricing and/or priority access to a future product offering. A reservation is not a purchase, pre-order, or sale of a watch, and does not guarantee that a product will be manufactured, launched, or delivered.
  • Crediting toward a pledge or purchase. If stated on the applicable product page, your deposit will be credited toward your eventual pledge (for example, on a crowdfunding platform such as Kickstarter) or toward a future purchase, subject to the terms disclosed at the time of reservation.
  • Refundability. Deposits are fully refundable at any time prior to conversion into a completed pledge or purchase, including if a campaign or launch is delayed, modified, or does not proceed, unless otherwise stated on the specific product page. To request a refund, contact us using the information in Section 12.
  • No guarantee of availability or timing. Product specifications, pricing, launch dates, and availability are subject to change. We will make reasonable efforts to communicate material changes to reservation holders but are not liable for delays or changes beyond our control.
  • Third-party crowdfunding platforms. If a product launches via a third-party platform (such as Kickstarter), your eventual pledge and purchase on that platform will also be governed by that platform's own terms and policies, in addition to these Terms.

4. Future Product Sales

If and when PHNTM begins direct sales of finished products through the Site, additional terms covering pricing, payment, shipping, delivery, risk of loss, returns, and warranties will apply and will be made available on the Site prior to purchase. We will update these Terms accordingly.

5. Pricing and Payment

All prices are listed in U.S. dollars unless otherwise stated. We reserve the right to correct pricing errors and to modify prices for future offerings at any time. Payment for deposits is processed through our third-party payment processor(s); we do not store your full payment card details.

6. Intellectual Property

All content on the Site — including the PHNTM name, logo, product names (such as "Paragon"), product designs, photography, graphics, and text — is the property of PHNTM Watch Co. LLC or its licensors and is protected by applicable intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any Site content without our prior written consent.

7. User Conduct

You agree not to:

  • Use the Site for any unlawful purpose or in violation of these Terms;

These Terms are governed by the laws of the Commonwealth of Massachusetts, without regard to its conflict-of-law principles.
